Accounts from the humanities which focus on describing the nature of whole body plastinates are examined. We argue that this literature shows that plastinates do not clearly occupy standard cultural binary categories of interior or exterior, real or fake, dead or alive, bodies or persons, self or other and argue that Noël Carroll’s structural framework for horrific monsters unites the various accounts of the contradictory or ambiguous nature of plastinates while also showing how plastinates differ from horrific fictional monsters. I. P. Ivanov conceptual ideas of upbringing are studied. There are the main ideas and methods of collective creative upbringing and including children in cooperation activity. The necessity of forming humanistic relationships of generations by including children in social creative activities is proved.

The article presents a systematic and detailed account of scholarly developments on the problem of studying the process of nation-building and the role of history, memory, language and culture in reflecting this process. The research reveals that according to the premordialist approach, nations are not formed instantaneously, by the relevant political will or by coincidence of circumstances; the process of creating and consolidating a nation is a long and meaningful one, full of historical events and national cultural tokens. The primordialist (...) concepts are considered unanimous in their recognition of the exceptional significance of psychological factors in the creation of a nation. The creation of a nation involves a sophisticated set of linguistic, religious, ethnic, territorial and myth-household factors that determine the formation of a corresponding type of sociality. The framework of the analytics of the phenomenon of a nation includes not only psychological, but also social, cultural, political, ethical, moral and axiological aspects. The new system-building concepts such as solidarity, habitus, plebiscite were added to the discussion of nation. In view of that, it is impossible to carry out the reduction of the phenomenon of a nation to a particular problem field and to localize it to invariant indicators. The formation and optimization of the capitalistic type of social system generates new factors in the interpretation and consolidation of a nation. The reasons for a political defeat in the development of a nation can be referedr to either conscious manipulative techniques, or spontaneous miscalculations. Elaborating the alternative versions of history is nothing but unjustified politicization, implementation of imperial and colonial ambitions, overcoming which is a necessary prerequisite for successful nation-building. The establishment and offsetting of such manipulative influence facilitate the stabilization of the social situation and the resolution of conflicts, and, consequently, contribute to national development. The key point is to establish a nation within the framework of the international and state policy, especially by distinguishing the consolidating and disintegrating influences of state and international politicies on nation-building. The policy of uniting the nation can become effective when the important reforms do not deepen the fragmentation of the nation, but rather neutralize it. (shrink)

Initial responses to questionnaires used to assess participants' understanding of informed consent for malaria vaccine trials conducted in the United States and Mali were tallied. Total scores were analyzed by age, sex, literacy (if known), and location. Ninety-two percent (92%) of answers by United States participants and 85% of answers by Malian participants were correct. Questions more likely to be answered incorrectly in Mali related to risk, and to the type of vaccine. For adult participants, independent predictors of higher scores (...) were younger age and female sex in the United States, and male sex in Mali. Scores in the United States were higher than in Mali (P = 0.005). Despite this difference participants at both sites were well informed overall. Although interpretation must be qualified because questionnaires were not intended as research tools and were not standardized among sites, these results do not support concerns about systematic low understanding among research participants in developing versus developed countries. This research aims to identify the ethical issues perceived by intensive care nurses in their everyday practice. It also aims to understand why these situations were considered an ethical issue and what interventions/strategies have been or are expected to be developed so as to minimize them. Data were collected using a semi-structured interview with 15 nurses working at polyvalent intensive care units in 4 Portuguese hospitals, who were selected by the homogenization of multiple samples. The qualitative content analysis identified end-of-life (...) decisions, privacy, interaction, team work, and health-care access as emerging ethical issues. Personal, team, and institutional aspects emerge as reasons behind the experience of these issues. Personal and team resources are used in and for solving these issues. We prove a generalization of Alex Heller's existence theorem for recursion categories; this generalization was suggested by work of Di Paola and Montagna on syntactic P-recursion categories arising from consistent extensions of Peano Arithmetic, and by the examples of recursion categories of coalgebras. Let B=BX be a uniformly generated isotypical B#-subcategory of an iteration category C, where X is an isotypical object of C. We give calculations for the existence of a weak Turing morphism in the Turing completion Tur of (...) B when C is separated; i.e., when connected domains in C are jointly epimorphic. Our proof generalizes as follows. Let D be a separated iteration category and let L : C → D be an iteration functor; i.e., a functor which preserves domains, coproducts, zero morphisms and the iteration operator; it is crucial for the generalization that an iteration functor need not preserve products. In 1978 and 1979 around 6.770 women in the GDR were infected with the hepatitis C virus after they had received a contaminated Anti-D-Immunprophylaxis. This prophylaxis was used after delivery, abortion or miscarriage. Until September 1979 2.769 women came down with Hepatitis. The reaction of the state showed how closely medicine and politics were linked in the GDR and what kind of influence governmental decisions had on medical action. The state wanted to keep everything as a secret. The producer of (...) the Anti-D-Immunglobulin in the GDR was sentenced as a pawn sacrifice in a non-public trial. The Ministry of State Security was also involved. Many of the infected women were traumatized by not being informed what had happened and had to fight for recognition and compensation until today. Building on the long-standing tradition of challenging oppression and questioning whose interests are being served in the field of language education, we report on a study that involved a group of U.S.-based graduate students who collaborated with a ninth-grade English teacher in Nepal. The study comes out of a larger project that sought to internationalize the curriculum of a graduate educational linguistics course at a U.S. university. At the heart of this internationalizing curriculum endeavour was a commitment to expose graduate (...) students in the U.S. to the issues of language teaching outside of the U.S. This was done through co-designing of a unit of lessons, with six graduate students meeting virtually with their teacher partner, Ditya, in Nepal over the course of a semester. The graduate students and Ditya constitute our research participants. The graduate student participants learned about the need to develop pedagogical materials that were relevant to the local context in Nepali classroom, and not attempt to transplant a Western-centric curriculum onto the Nepali classroom. In keeping with recent calls to decolonize higher education, we illustrate how critical theory in general and decolonizing pedagogy in particular can be infused into a U.S. graduate curriculum by drawing on the rich, indigenous knowledge and resources of a teacher collaborator from the Global South. We do this by reporting how this critical, decolonizing goal was realized through collaborative professionalism, which is characterized by the sharing of knowledge, skills, and experience to improve student achievement, reflection, dialogue and collective responsibility. The Units of Selection debate is a dispute about the causes of population change. I argue that it is generated by a particular `dynamical'' interpretation of natural selection theory, according to which natural selection causes differential survival and reproduction of individuals and natural selection explanations cite these causes. I argue that the dynamical interpretation is mistaken and offer in outline an alternative, `statistical'' interpretation, according to which natural selection theory is a fancy kind of `bookkeeping''. It explains by citing the (...) statistical structure of a population and not by citing the causes of survival and reproduction. From the perspective of the statistical interpretation there is no substantive Units of Selection issue. (shrink)

Impossibility theorems for 2-person and majority continuous games on the unit circle are presented. The emphasis is on simple methods, albeit generating new results, to offer insights into the sophisticated results of theorists in topological social choice.

The amount of information that is produced on a daily basis in the financial markets is vast and complex; consequently, the development of systems that simplify decision-making is an essential endeavor. In this article, several intelligent systems are proposed and tested to predict the closing price of the IBEX 35 index using more than ten years of historical data and five distinct architectures for neural networks. A multi-layer perceptron was the first step, followed by a simple recurrent neural network, a (...) gated recurrent unit network and two long-short-term memory (LSTM) networks. The results of the analyses performed on these models have demonstrated a powerful capacity for prediction. Additionally, the findings of this research point to the fact that the application of intelligent systems can simplify the decision-making process in financial markets, which is a substantial advantage. Furthermore, by comparing the predicted outcome errors between the models, the LSTM presents the lowest error with a higher computational time in the training phase. The LSTM was able to accurately forecast the closing price of the day as well as the price for the following one and two days in advance. In conclusion, the empirical results demonstrated that these models could accurately predict financial data for trading purposes and that the application of intelligent systems, such as the LSTM network, represents a promising advancement in financial technology. Kidneys for transplantation are scarce, and many countries give priority to children in allocating them. This paper explains and criticizes the paediatric priority. We set out the relevant ethical principles of allocation, such as utility and severity, and the relevant facts to do with such matters as sensitization and child development. We argue that the facts and principles do not support and sometimes conflict with the priority given to children. We next consider various views on how age or the status (...) of children should affect allocation. Again, these views do not support priority to children in its current form. Since distinctions based on age ought to be positively justified, the failure of all these attempts at justification implies that the priority to children is ethically mistaken. Finally, the paper points to evidence that the paediatric priority reduces the overall supply of kidneys, at least in the United States. Paediatric priority is a real-world policy that seems discriminatory, in some places probably reduces the supply of organs, has no robust official defence, and is unsupported by mainstream ethical principles. Recent years have seen a surge in accounts motivated by information theory that consider language production to be partially driven by a preference for communicative efficiency. Evidence from discourse production (i.e., production beyond the sentence level) has been argued to suggest that speakers distribute information across discourse so as to hold the conditional per-word entropy associated with each word constant, which would facilitate efficient information transfer (Genzel & Charniak, 2002). This hypothesis implies that the conditional (contextualized) probabilities of linguistic units (...) affect speakers’ preferences during production. Here, we extend this work in two ways. First, we explore how preceding cues are integrated into contextualized probabilities, a question which so far has received little to no attention. Specifically, we investigate how a cue's maximal informativity about upcoming words (the cue's effectiveness) decays as a function of the cue's recency. Based on properties of linguistic discourses as well as properties of human memory, we analytically derive a model of cue effectiveness decay and evaluate it against cross-linguistic data from 12 languages. Second, we relate the information theoretic accounts of discourse production to well-established mechanistic (activation-based) accounts: We relate contextualized probability distributions over words to their relative activation in a lexical network given preceding discourse. ABSTRACT This paper is intended to stimulate debate amongst stakeholders in the international research community on the topic of returning individual genetic research results to study participants. Pharmacogenetics and disease genetics studies are becoming increasingly prevalent, leading to a growing body of information on genetic associations for drug responsiveness and disease susceptibility with the potential to improve health care. Much of these data are presently characterized as exploratory (non‐validated or hypothesis‐generating). There is, however, a trend for research participants to be (...) permitted access to their personal data if they so choose. Researchers, sponsors, patient advocacy groups, ethics committees and regulatory authorities are consequently confronting the issue of whether, and how, study participants might receive their individual results. Noted international ethico‐legal guidelines and public policy positions in Europe and the United States are reviewed for background. The authors offer ‘Points‐to‐Consider’ regarding returning research results in the context of drug development trials based on their knowledge and experience. These considerations include: the clinical relevance of data, laboratory qualifications, informed consent procedures, confidentiality of medical information and the competency of persons providing results to participants. The discussion is framed as a benefit‐to‐risk assessment to balance the potential positive versus negative consequences to participants, while maintaining the integrity and feasibility of conducting genetic research studies. The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research. In a recent article [Mertz 2001] in this journal I argued for the virtues of a realist ontology of relation instances (unit attributes). A major strength of this ontology is an assay of ontic ('material') predication that yields an account of individuation without the necessity of positing and defending 'bare particulars'. The crucial insight is that it is the unifying agency or combinatorial aspect of a relation instance as predicable that is for ontology the principium individuationis [Mertz 2002; 1996]. Or (...) in short, what is ontically predicable, precisely as such, is the cause of individuation. As a preface to this positive doctrine I offered arguments against the coherence of bare particulars as defended in an article by J. P. Moreland [1998]. In a reply contained in this issue Moreland and Timothy Pickavance (hereafter M/P) propose to answer my objections [2002]. The response that follows provides reasons why, I contend, M/P have not succeeded in parrying my objections to bare particulars. (shrink)

This article seeks to present Vygotsky's theoretical perspective as an integral whole as an antidote to the desire to plunder his work for isolated insights. The first part of the paper treats Vygotsky's views on method: his critique of the prevailing psychological orthodoxies; his recommendation that the higher mental functions be seen as standing in interfunctional relations of mutual determination; his technique of 'unit analysis'. The second part discusses the method in action: Vygotsky's genetic account of the development of consciousness, (...) on which the key point in ontogenesis is taken to be the convergence of two intitially independently developing faculties: thought and speech; the notion of internalisation and its defence; the critique of Piaget; the concept of 'inner speech' and developed thought. First, (...) different sources of HESCs are distinguished and the distinct moral objections that might apply to each. Second, it is argued that none of the properties plausibly conferring personhood on an entity is possessed by human embryos, and then shown how destruction of an embryo for research with the prospect of important medical benefits can be compatible with respecting it. Third, it is shown that the main objection to human cloning is only to reproductive cloning and that the objection to creating human beings with the intention of destroying them does not apply to SCNT. Finally, the concern that acquiring human eggs for SCNT would involve exploiting women donors is addressed, and it is shown how that can be avoided.Human embryonic stem cell research has become one of the more politically and morally controversial issues of our time. There is wide variability in what HESC research, if any, is permitted in countries around the world. This paper examines the debate over the relationship between the public sphere and communication, which has become a focus of attention after the publication of Jürgen Habermas's Structural Transformation of Public Sphere in English in 1989, following the two volumes of his The Theory of Communicative Action in 1984 and 1987. Although the historical account of the public sphere has also received a good deal of attention, I deal mainly with the normative dimension of Habermas's theory as it led to (...) a rethinking and reassessment of public broadcasting, to the end of restructuring it as a site where 'citizens act as a public'. That is to say, a site where people assemble and unite freely, and express and publicize their opinions on matters of general interest without constraint in an age of deregulated communications. Several scholars have provided us with maps for re-organizing the media of communications in this respect, but they have failed to analyze the 'information' which feeds the 'informed citizen'. This paper addresses not only what information means today—whether it is a digit, a signal, or content—but also how it is produced within daily routine practices and how the nature of the means of its dissemination influences its character. Another serious aspect of those assessments, including that of Habermas, is the global character of communications today. Habermas is well aware of the mismatch between the global market and the absence of its corollary in politics. Yet his silence in the economics of information, even as he acknowledges the digitalization of communications and 'a world public sphere', also calls for a critical account of the relations between 'information', democratic politics and the question of scale. This chapter is an essay in a volume that examines constitutional law in the United States through the lens of H.L.A. Hart's "rule of recognition" model of a legal system. My chapter focuses on a feature of constitutional practice that has been rarely examined: how jurists and scholars argue about interpretive methods. Although a vast body of scholarship provides arguments for or against various interpretive methods -- such as textualism, originalism, "living constitutionalism," structure-and-relationship reasoning, representation reinforcement, minimalism, and so forth (...) -- very little scholarship shifts to the meta-level and asks: What are the considerations that jurists and scholars bring to bear in arguing that one or another interpretive method is legally favored? And can we "make sense" of this body of argument? Is there a model of legal discourse that both accurately describes how U.S. jurists and scholars actually argue about interpretive methods, and that vindicates this discourse (in the sense of seeing these actors as making valid arguments)? I find that Hart's rule-of-recognition model fails to describe or vindicate how U.S. jurists and scholars argue about interpretive methods. The problem, in a nutshell, is that Hart sees legal argument as asserting or presupposing the social fact of contemporary official acceptance of a rule of recognition. By contrast, jurists and scholars typically point to social facts other than contemporary official acceptance in arguing for the legal status of an interpretive method -- for example, the fact that the method is supported by Framers' intent, or by U.S. culture and tradition, or by precedent. Further, jurists and scholars very often argue that some interpretive method is legally favored even though the method is controversial. On Hart's model, such a claim is problematic -- because, on his model, the content of the rule of recognition is not controversial, but rather a matter of consensus among officials. The upshot may just be that Hart's model is a failure. However, another possibility is to adopt an "error theory" of U.S. constitutional discourse. It may perhaps be the case that U.S. jurists and scholars often make claims for the favorable legal status of some interpretive method that are inconsistent with the best understanding of the nature of law. In this paper I contend that the 'superfluity' of triangles is only apparent; all those specified are indeed required for the smallest sub-units, so long as the symmetry of the final body to be constructed is taken into account at earlier stages.

In this essay I endeavor to provide such an account, and describe at a pretheoretical level an embodied subjectivity at odds with its own state of embodiment, and on the other hand, to explore the limited agency induced by constraints that fall upon an embodied subject who is compelled to live a body which is free to engage the various possibilities of the world in every respect except one, within the context of an intercorporeal social reality. This description will provide (...) a sound ontological foundation where the central place of embodiment in the abortion debate can be re-asserted and properly taken into account. What this description will reveal is the ontological drama of such “aversely pregnant subjectivities” at a time when ever more legislation is being passed that poses ever more restrictions on reproductive rights of women in the United States. This investigation is all the more pertinent in light of Justice Anthony Kennedy’s recent announcement that he is retiring from the U.S. Supreme Court, which may well put the right to legal abortions in jeopardy. My highest ambition, however, is to convey the significance of these restrictions to those who have never been and never can become pregnant, but who by and large determine the polices that play a substantial role in shaping such subjectivities. Tax compliance is a concern to governments around the world. Prior research (Alm, J. and I. Sanchez: 1995, KYKLOS 48, 3–19) has attributed unexplained inter-country differences in compliance rates to differences in social norms. Economics researchers studying tax compliance in the United States (U.S.) (see for example J. Andreoni et al.: 1998, Journal of Economic Literature 36, 818–860) have called for more attention to social (as opposed to economic) influences on tax compliance. In this study, we extend this prior research (...) by explicitly examining the role of social norms [Cialdini, R. and M. Trost: 1998, The Handbook of Social Psychology (Oxford University Press, New York)] on tax compliance in three different countries. We test our research hypotheses using a hypothetical compliance scenario, which was administered in Australia, Singapore, and the U.S. There were differences in compliance rates and social norms among the three countries. Factor analysis of the social norm questions identified three distinct social norm constructs. Two of these factors were significant in explaining tax compliance behavior. The first and most influential factor was taxpayers’ own personal moral beliefs, along with the beliefs of those close to them (e.g., friends and important others). The second significant factor represented societal views of proper behavior. We conclude that social norms help to explain tax compliance intentions and why tax compliance rates are higher than would be predicted by strictly economic models. (shrink)

How is the sense (knowledge and feelings) of community produced? What roles do various units of society play in producing such knowledge and feelings? What are the values of the ethic engendered by such knowledge and feelings? I suggest that a communitarian theory indigenous to African culture enables us to respond to these questions. Against the objections of those who advocate an ideology of modern democratic liberalism, I argue that the values of individual worth and freedom are indeed compatible with (...) those of communitarianism. Further, while I agree that communities are natural orders into which individuals are born, I deny any ontological determinism that would seek to restrict such orders in terms of ethnicity or race. Rather, communities also need to be understood as products of deliberate human organization and choices. (shrink)

An ontology's theory of ontic predication has implications for the concomitant predicate logic. Remarkable in its analytic power for both ontology and logic is the here developed Particularized Predicate Logic (PPL), the logic inherent in the realist version of the doctrine of unit or individuated predicates. PPL, as axiomatized and proven consistent below, is a three-sorted impredicative intensional logic with identity, having variables ranging over individuals x, intensions R, and instances of intensions $R_{i}$ . The power of PPL is illustrated (...) by its clarification of the self-referential nature of impredicative definitions and its distinguishing between legitimate and illegitimate forms. With a wellmotivated refinement on the axiom of comprehension, PPL is, in effect, a higher-order logic without a forced stratification of predicates into types or the use of other ad hoc restrictions. The Russell-Priest characterization of the classic self-referential paradoxes is used to show how PPL diagnosis and solves these antimonies. A direct application of PPL is made to Grelling's Paradox. Also shown is how PPL can distinguish between identity and indiscernibility. (shrink)

This volume explores the reasons for Hans Kelsen’s lack of influence in the United States and proposes ways in which Kelsen’s approach to law, philosophy, and political, democratic, and international relations theory could be relevant to current debates within the U.S. academy in those areas. Along the way, the volume examines Kelsen’s relationship and often hidden influences on other members of the mid-century Central European émigré community whose work helped shape twentieth-century social science in the United States. The book includes (...) major contributions to the history of ideas and to the sociology of the professions in the U.S. academy in the twentieth century. Each section of the volume explores a different aspect of the puzzle of the neglect of Kelsen’s work in various disciplinary and national settings. Part I provides reconstructions of Kelsen’s legal theory and defends that theory against negative assessments in Anglo-American jurisprudence. Part II focuses both on Kelsen’s theoretical views on international law and his practical involvement in the post-war development of international criminal law. Part III addresses Kelsen’s theories of democracy and justice while placing him in dialogue with other major twentieth-century thinkers, including two fellow émigré scholars, Leo Strauss and Albert Ehrenzweig. Part IV explores Kelsen’s intellectual legacies through European and American perspectives on the interaction of Kelsen’s theoretical approach to law and national legal traditions in the United States and Germany. Each contribution features a particular applications of Kelsen’s approach to doctrinal and interpretive issues currently of interest in the legal academy. Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. This article seeks to present Vygotsky's theoretical perspective as an integral whole as an antidote to the desire to plunder his work for isolated insights. The first part of the paper treats Vygotsky's views on method: his critique of the prevailing psychological orthodoxies; his recommendation that the higher mental functions be seen as standing in interfunctional relations of mutual determination; his technique of unit analysis. The second part discusses the method in action: Vygotsky's genetic account of the development of consciousness, (...) on which the key point in ontogenesis is taken to be the convergence of two initially independently developing faculties: thought and speech; the notion of internalisation and its defence; the critique of Piaget; the concepts of inner speech and developed thought. This paper focuses on medical ghostwriting in the United States. I argue that medical ghostwriting often involves plagiarism and, in those cases, can be treated as an act of research misconduct by both the federal government and research institutions. I also propose several anti‐ghostwriting measures, including: 1) journals should implement guarantor policies so that researchers may be better held accountable for their work; 2) research institutions and the federal government should explicitly prohibit medical ghostwriting and outline appropriate penalties; and 3) (...) a publicly available database should be created to record researchers' ethics violations. Food charity in the United States has grown into a critical appendage of agro-food supply chains. In 2016, 4.5 billion pounds of food waste was diverted through a network of 200 regional food banks, a fivefold increase in just 20 years. Recent global trade disruptions and the COVID-19 pandemic have further reinforced this trend. Economic geographers studying charitable food networks argue that its infrastructure and moral substructure serve to revalue food waste and surplus labor in the capitalist food system. The (...) political–legal framework undergirding this revaluation process however is still poorly understood. Drawing on a 6-year institutional ethnography of the food banking economy in West Virginia, this paper takes a supply-side approach to examine the material and moral values driving the expansion of food waste recovery as hunger relief. Empirically, it focuses on the laws, contracts and fiscal incentives regulating charitable food procurement at the U.S. Department of Agriculture and Feeding America. The assemblage of government agencies, private businesses and non-profit organizations enrolled into this gift economy at different scales I argue, serves to enclose food waste into a public–private governance structure that regulates food surpluses and ensures these will not disrupt the scarcity logics driving profitability along primary food circuits. American polygenism was a provocative scientific movement whose controversial claim that humankind did not share a common ancestor caused a firestorm among naturalists and the lay public beginning in the 1830s. This article gives specific attention to the largely overlooked religious ideas marshaled by American polygenists in their effort to construct race as a unit of analysis. I focus specifically on the thought of the American polygenist and renowned surgeon Dr Josiah Clark Nott (1804–73) of Mobile, Alabama. Scholars have claimed (...) that in his effort to establish a properly modern scientific view of race Nott was one of the first American naturalists to publicly denounce the notion of common human descent (monogenesis) as proclaimed in the Bible. I argue that despite his rejection of monogenesis, Nott’s racial theory remained squarely within the tradition of Christian ideas about the natural world. American polygenism provides an example of how scientific and religious ideas worked together in the minds of American antebellum thinkers in the development of novel theories about race and human origins. As far as I know, this is the first book-length study of Ernst Tugendhat in English. That is a bit of a surprise since Tugendhat is the last of Heidegger's students who went on to develop a significantly distinct philosophical approach, and it was one closer to the practice of philosophy in the United States and England than in Germany. The fact that this book is the author's expanded translation from the Italian probably indicates that this lack of attention to (...) Before commenting on the “Introduction” to Telos 108 by Piccone, Berman and Ulmen, I want to cite two distinctions relevant to my discussion of it. First, federalism and populism are separate concepts, whatever it turns out is the proper meaning of populism and whether or not the intent of the Introduction was to argue for both. Federalism concerns a type of social organization held to be preferable for relatively complex commercial societies; the kind of societies that presently dominate the first (...) world. It consists of relatively autonomous units united under a mutually agreed upon constitutional framework assigning strictly limited responsibilities and duties to a central state authority. (shrink)

The medical profession’s role should be limited to advice and informationThe medical establishment’s desire to interfere with the autonomous wishes of boxers seems at odds with the principle of respect for autonomy prevalent in contemporary biomedical practice. I argue that the role of the medical profession in boxing should be solely an advisory and informational one. In addition, the distinctions made between boxing and other high risk sports often rely on an insufficient knowledge of the sport. This leads to misdirected (...) criticisms and excessive emphasis on the colourful discourse of boxing, as opposed to the practice of boxing itself. Dr Herrera’s claim in his article that boxing differs from other sports in the acceptability of its acts outside the realm of sport is refuted.1 The importance of consent as a legitimising factor is highlighted, and a number of possible solutions to improve safety within the sport are tentatively suggested.In the United Kingdom, a competent adult may legally refuse medical treatment, irrespective of the severity of his condition or the validity of his reasons. With the pre-eminence of an autonomy based model of bioethics, respecting a patient’s wishes forms an integral part of acting in his best interests. It is puzzling, then, to find that the Australian Medical Association have called for a ban on boxing on the grounds that the activity is excessively hazardous to the health of boxers. In this paper, I claim that extant empirical data do not support a radically embodied understanding of the mind but, instead, suggest (along with a variety of other results) a massively representational view. According to this massively representational view, the brain is rife with representations that possess overlapping and redundant content, and many of these represent other mental representations or derive their content from them. Moreover, many behavioral phenomena associated with attention and consciousness are best explained by the coordinated activity (...) of units with redundant content. I finish by arguing that this massively representational picture challenges the reliability of a priori theorizing about consciousness. (shrink)

The language we use over the course of conversation changes as we establish common ground and learn what our partner finds meaningful. Here we draw upon recent advances in natural language processing to provide a finer‐grained characterization of the dynamics of this learning process. We release an open corpus (>15,000 utterances) of extended dyadic interactions in a classic repeated reference game task where pairs of participants had to coordinate on how to refer to initially difficult‐to‐describe tangram stimuli. We find that (...) different pairs discover a wide variety of idiosyncratic but efficient and stable solutions to the problem of reference. Furthermore, these conventions are shaped by the communicative context: words that are more discriminative in the initial context (i.e., that are used for one target more than others) are more likely to persist through the final repetition. Finally, we find systematic structure in how a speaker's referring expressions become more efficient over time: Syntactic units drop out in clusters following positive feedback from the listener, eventually leaving short labels containing open‐class parts of speech. These findings provide a higher resolution look at the quantitative dynamics of ad hoc convention formation and support further development of computational models of learning in communication. The mass killings, large-scale gang rape and large-scale expulsion of the Rohingyas from Myanmar constitute one of the most repugnant world events in recent years. This article addresses the question of whether armed humanitarian intervention would have been morally permissible to protect the Rohingyas. It approaches the question from the perspective of the jus ad bellum criteria of just war theory. This approach does not yield a definitive answer because knowing whether certain jus ad bellum conditions might have been satisfied (...) is difficult to judge without detailed knowledge of military intelligence assessments. Nevertheless, I argue that there was just cause for intervention according to both liberal and communitarian perspectives; that legitimate authority in the form of United Nations Security Council authorization would not have been morally necessary; that it is doubtful whether permissible intervention would have required humanitarian intent; that in late August 2017, intervention might well have been a last resort, but that morally relevant facts suggest intervention might have been disproportionate and lacked a reasonable chance of success, such that, all things considered, it would have perhaps been impermissible. -/- (Free access via third external link). This dissertation lays the foundation for a new theory of non-relational intentionality. The thesis is divided into an introduction and three main chapters, each of which serves as an essential part of an overarching argument. The argument yields, as its conclusion, a new account of how language and thought can exhibit intentionality intrinsically, so that representation can occur in the absence of some thing that is represented. The overarching argument has two components: first, that intentionality can be profi tably studied (...) through examination of the semantics of intensional transitive verbs (ITVs), and second, that providing intensional transitive verbs with a nonrelational semantics will serve to provide us with (at least the beginnings of) a non-relational theory of intentionality. This approach is a generalization of Anscombe's views on perception. Anscombe held that perceptual verbs such as "see" and "perceive" were ITVs, and that understanding the semantics of their object positions could help us to solve the problems of hallucination and illusion, and provide a theory of perception more generally. I propose to apply this strategy to intentional states and the puzzles of intentionality more generally, and so Anscombe's influence will be felt all through the dissertation. -/- In the first chapter, titled "Semantic Verbs are Intensional Transitives", I argue that semantic verbs such as "refers to", "applies to", and "is true of" have all of the features of intensional transitive verbs, and discuss the consequences of this claim for semantic theory and the philosophy of language. One theoretically enriching consequence of this view is that it allows us to perspicuously express, and partially reconcile two opposing views on the nature and subject-matter of semantics: the Chomskian view, on which semantics is an internalistic enterprise concerning speakers' psychologies, and the Lewisian view, on which semantics is a fully externalistic enterprise issuing in theorems about how the world must look for our natural language sentences to be true. Intensional Transitive Verbs have two readings: a de dicto reading and a de re reading; the de dicto reading of ITVs is plausibly a nonrelational reading, and the intensional features peculiar to this reading make it suitable for expressing a Chomskian, internalist semantic program. On the other hand, the de re reading is fully relational, and make it suitable for expressing the kinds of word-world relations essential to the Lewisian conception of semantics. And since the de dicto and de re readings are plausibly related as two distinct scopal readings of the very same semantic postulates, we can see these two conceptions of semantics as related by two scopal readings of the very same semantic postulates. -/- In chapter two, titled "Hallucination and the New Problem of Empty Names", I argue that the problem of hallucination and the problem of empty names are, at bottom, the same problem. I argue for this by reconstructing the problem of empty names in way that is novel, but implicit in much of the discussion on empty names. I then show how, once recast in this light, the two problems are structurally identical down to an extremely fine level of granularity, and also substantially overlap in terms of their content. If the problems are identical in the way I propose, then we should expect that their spaces of solutions are also identical, and there is signi cant support for this conclusion. However, there are some proposed solutions to the problem of hallucination that have been overlooked as potential solutions to the problem of empty names, and this realization opens new non-relational approaches to the problem of empty names, and to the nature of meaning more generally. -/- In chapter three, titled "Intensionality is Additional Phrasal Unity", I argue for a novel approach to the semantics of intensional contexts. At the heart of my proposal is the Quinean view that intensional contexts should, from the perspective of the semantics, be treated as units, with the material in them contributing to the formation of a single predicate. However, this proposal is subject to a number of objections, including the criticism that taken at face value, this would render intensional contexts, which seem to be fully productive, non-compositional. I begin by discussing the concept of the unity of the phrase, and pointing to various ways that phrases can gain additional unity. I then proposes that the intensionality of intensional transitive verbs is best construed as a form of semantic incorporation; ITVs, on their intensional readings, meet all of the criteria for qualifying as incorporating the nominals in their object positions. I then give a semantics for ITVs that builds on existing views of the semantics of incorporation structures, and gesture at how this can be extended to intensional clausal verbs, including the so-called propositional attitude verbs. Hannah Arendt has been criticized for her “blindness” to the sociopolitical significance of race and racism in the West, most notably, in her “Reflections on Little Rock.” I consider three prominent explanations for Arendt's wrongheaded conclusions in “Reflections.” First, the “category interpretation” presents Arendt's conclusions as resulting from her rigid application of philosophical categories—the public, the private, and the social—to events in Little Rock. Second, the “racial prejudice interpretation” presents Arendt's conclusions as resulting from her anti-black racism and her dismissal (...) of the political strivings of African Americans. Third, the “cultural interpretation” presents Arendt's conclusions as resulting from her misunderstanding of the sociopolitical significance of race and racism in the United States. Each of these interpretations advances our understanding of Arendt's oversights, but I contend that they do not go far enough. I argue that white ignorance constitutes a fundamental epistemic error in Arendt's work and, as such, strengthens current explanations of Arendt's “blindness” to the history and political strivings of African Americans. If accepted, my analysis—following Charles Mills's work on white ignorance—calls for increased theoretical work on epistemologies of ignorance, their function in Western political philosophy, and the affect of white ignorance on cognizers in American society. Decoding the function and meaning of a foreign culture's sounds and gestures is a notoriously difficult problem. It is even more challenging when we think about the sounds and gestures of nonhuman animals. This essay provides a review of what is currently known about the informational content and function of primate vocalizations, emphasizing the problems underlying the construction of a primate “dictionary.” In contrast to the Oxford English Dictionary, this dictionary provides entries to emotional expressions as well as potentially referential (...) expressions. It therefore represents a guide to what animals do with their vocalizations, as well as how they are represented by signalers and perceivers. I begin by a discussion of the unit problem, of how an acoustic space is carved up into functionally significant components leading to a species‐specific repertoire or lexicon of sorts. This section shows how little we know about the units of organization within animal vocal repertoires, and how such lack of information constrains our ability to tackle the problem of syntactic structure. In Section III, I review research on the production and perception of vocal signals that appear to be functionally referential. This work shows that several nonhuman primates produce vocalizations that share some of the key properties of reference, but certainly not all; the components that are missing raises questions about their role as precursors to human words. In Section IV, I explore the social uses of vocalizations, assessing whether the signal contains sufficient information for listeners to judge a caller's credibility; ultimately, caller credibility determines how receivers select an appropriate response. Results show that individuals can use calls to assess whether someone is reliable or unreliable, and that such attributes are associated with individuals and particular contexts. I conclude by synthesizing the issues presented and then raise some directions for future conceptual and methodological progress. (shrink)

Complex life cycles are common in the eukaryotic world, and they complicate the question of how to define individuality. Using a bottom-up, gene-centric approach, I consider the concept of fitness in the context of complex life cycles. I analyze the fitness effects of an allele on different biological units within a complex life history and how these effects drive evolutionary change within populations. Based on these effects, I attempt to construct a concept of fitness that accurately predicts evolutionary change in (...) the context of complex life cycles. (shrink)
